Kunadha joined Watson Farley & Williams as an Associate in 2012 and re-joined in 2016 after completing his Master of Laws from University College London (Chevening scholarship). His experience ranges from international arbitration and commercial litigation matters including commercial, labour, intellectual property, transportation, insurance, and construction disputes as well as non-contentious matters. Kunadha has been a Thai qualified lawyer since 2012 and is a certified Thai notarial services attorney.

    Kunadha’s experience includes:
    Arbitration
    • Acting for a Thai paper manufacturer in disputes with a Chinese machinery manufacturer and a Chinese state-linked corporation concerning supply of deficient machinery. Claims in excess of US$50m were brought for breach of contract, misrepresentation and enforcement of guarantee obligations. (HKIAC/UNCITRAL; Chinese law).
    • Acting for Thai entities of a Dutch renewable energy solutions consultancy and a Dutch food conglomerate in an ICC arbitration concerning wrongful termination of contract and consequent claims for damages. (ICC; Thai law).
    • Acting for property investors in a dispute concerning a luxury development project in Phuket, Thailand under sales purchase agreement and guarantee rental arrangements. (Board of Trade of Thailand; Thai law).
    • Acting as lead-counsel for a company director against a major Thai insurance public company claiming for compensation under a life insurance policy. (Office of Insurance Commission of Thailand; Thai law).
    • Acting in matters concerning enforcement of various arbitral awards in the Thai courts under the New York Convention.
    Litigation
    • Representing a major Thai rice exporter in a liability claim against international carriers and ship agents in relation to a rice contamination incident. Claims in excess of US$3m were brought for wrongful act, negligence and breach of agreement.
    • Representing a public listed Chinese hotel group against a renowned US convenient store corporation in relation to trademark infringement in the Thai courts and objection of trademark application at the Thai Department of Intellectual Property.
    • Representing one of the largest rubber glove manufacturers in a claim against a group of traders in Thailand in the Thai courts for breach of 19 sale purchase agreements as well as enforcement of the court judgment.
    • Advising a Thai public listed engineering company regarding purchase of shares from a major Thai wind energy company and issues pertaining to possible liability from ICC arbitral proceedings and Thai court litigation.
    • Representing Thai and overseas clients in various labour disputes for unfair dismissal, breach of employment agreement and claim for severance pay in the Thai courts.
    • Representing clients in enforcement of Thai court judgments with the Thai Legal Execution Department.
