Nick is a Partner in the firm’s Energy & Infrastructure group in London. Nick qualified in 2008 and works on planning, environmental and health and safety matters. Nick regularly works with public, corporate and private clients across a wide range of sectors and jurisdictions. In the past 12 months, Nick has advised extensively on a variety renewable energy projects including: over 60 solar projects; on and offshore wind (including radar mitigation agreements) and biomass projects. Nick also advised Eco World Investment Co Ltd on the planning aspects of a joint venture with Ballymore to bring forward three large-scale London residential developments of close to 2500 units, with a gross development value of approximately £2.2bn.

    Environmental Experience:
    • BP: Providing legal support to BP’s Safety and Operational Risk (S&OR and Incident Response Teams.
    • Air BP: advising on the HSE aspects of the purchase of Statoil Fuel & Retail Aviation AS, including co-ordinating cross border due diligence of 73 airports in the Nordic countries and Northern Europe.
    • Supermajor: advising on the decommissioning requirements relating to a Floating Production Storage and Offloading Unit (FPSO) and in relation to the HSE aspects of a project to install a LNG Floating Storage and Regassification Vessel off the coast of the UK.
    • Electricity Transmission System Operator (TSO): advising on a potential prosecution by the Marine Management Organisation relating to alleged breaches of a Marine Licence in connection with the installation of one of the largest voltage source conversion (VSC) High Voltage Direct Current interconnectors in operation worldwide.
    • Investment Fund: advising on European Commission infringement proceedings in relation to the Bird and Habitats Directives and the potential impacts on its investment in the largest offshore wind farm in the Member State; providing related advice on meeting European Investment Bank and Equator Principle requirements for its portfolio of EU renewable projects.
    • Waste: Defending clients in prosecutions brought under the Environmental Permitting Regulations and the Environmental Protection Act, including:
      • construction and demolition waste, permitting requirements for mobile plant;
      • operating a waste transfer station without an Environmental Permit;
      • unauthorised deposit of controlled waste;
      • End of Life Vehicles – involving alleged transfrontier shipment of waste.
    • Compliance schemes:
      • Drafted Operational Plan for a client’s application to operate a packaging compliance scheme – successfully obtained approval from DEFRA and the Environment Agency for the scheme.
      • Advising in the successful appeal of an Environment Agency refusal of a client’s licence to operate a WEEE compliance scheme.
      • Acting for clients prosecuted under the Producer Responsibility Obligations (Packaging Waste) Regulations.
      • Advising on Carbon Reduction Commitment (CRC) liabilities and negotiating CRC provisions in leases on behalf of landlords and tenants.
    Health & Safety/Product Safety Experience:
    • The Crown Estate: advising the Energy and Infrastructure team on environmental and health and safety issues, including undertaking an audit of its entire offshore portfolio and drafting a health and safety ‘toolkit’ for use in all of its offshore contracts.
    • REACH: advising clients on the time limits for updating Safety Data Sheets (SDS), importing restrictions for manufacturers outside the EU, the obligations of downstream users, drafting and negotiating Only Representative Agreements and advising a major plastics manufacturer on the preparation of a REACH downstream user chemical safety report. Providing related advice on the CLP Regulations and GHS.
    • ROHS:
      • Advising a technology and electronics systems multinational on a potential breach of its obligations under RoHS, including liaising with the regulator, the National Measurements Office.
      • Advising a manufacturer of aeronautics equipment on the scope of the RoHS and reliance upon the military exemption.
      • Advising a US biotech company on a potential breach of the RoHS Regulations and the potential exclusions.
    • Medicines, healthcare and narcotics:
      • Advising a chemicals manufacturer on its obligations under the Medicines for Human Use (Manufacturing, Wholesale Dealing and Miscellaneous Amendments) Regulations 2005 (the Regulations) and the related Good Manufacturing Practice (GMP) Guidelines.
      • Advising a plastics manufacturer on the requirements of a licence to store Category 1 & 2 products under the Controlled Drugs (Substances Useful for Manufacture) Intra Community Trade Regulation 2005.
      • Advising a chemicals manufacturer on its potential liability across the EU for the sale, storage and transport of narcotic precursors.
      • Advising an international health drink manufacturer on labelling requirements and medicinal claims. Advising a medical devices manufacturer on a number of potential product liability issues relating to wound healing technologies, including notification to and liaison with the MHRA, the UK regulator.
      • Advising a manufacturing client on its obligations to report accidents at work under RIDDOR, including advising on incidents relating to inhalation of noxious fumes, exposure to asbestos and occupational dermatitis.
    • Explosives and terrorism:
      • Advising a manufacturer of an explosive precursor on its potential liabilities across the EU for catastrophic incidents and/or terrorist attacks at its facilities and during transportation.
      • Advising a healthcare multinational on its obligations under the ATEX Directives (the EU control of explosion risk regime) and a related breach of warranty claim.
      • Advising a top tier COMAH site on the updating of its COMAH documentation, including The Major Accident Prevention Policy, safety report and a site major emergency plan.
    • Product recall:
      • Advising a lubes manufacturer on a number of product recall issues.
      • Advising a manufacturer of household electrical appliances on a potential product recall.
      • Advising a power tool manufacturer on labelling requirements.
    Planning Experience:
    • Eco World: advising on the planning aspects of a joint venture with Ballymore to bring forward three large-scale London residential developments of close to 2500 units with a gross development value of approximately £2.2bn. Responsible for negotiating the planning aspects of all of the transaction documents.
    • DP World: advising on planning matters in relation the £1.5bn London Gateway project, including  its application for a Local Development Order (including JR proofing),  on the exercise of compulsory purchase powers pursuant to a Harbour Empowerment Order and in relation to planning applications in the Green Belt.
    • HB Reavis: objecting to an application by Transport for London (TfL) for a Transport and Works Act Order for a major infrastructure project in the City of London (including extensive preparations for the public Inquiry and settlement negotiations with TfL).
    • Acted for multiple clients on a broad range of contentions and non-contentious planning matters, including:
      • Judicial Review and Section 288 appeals;
      • drafting and negotiating Section 106 Agreements and Unilateral Undertakings;
      • objecting to Compulsory Purchase Orders;
      • drafting and negotiating protective provisions and settlement agreements;
      • advising on highway and footpath matters;
      • Village Green applications;
      • Common land (registration and deregistration);
      • defending prosecutions  for unauthorised demolition in a Conservation Area and unauthorised works to Listed Buildings;
      • Section 215 Notice appeals;
      • drafting and negotiating Certificates of Title.
