We discussed the EU Emissions Trading Scheme (EU ETS), which came into force for shipping on 1 January 2024.

Partner Dr Clemens Hillmer from our Hamburg office gave an overview of the legal framework and initial practical experience in dealing with the EU ETS:

  • What are the developments regarding amendments to charter parties and management agreements?
  • What needs to be considered in MoAs?
  • How does the EU ETS affect ship financing?

Our Counsel Vagelis Liouskos and Senior Associate Panagiotis Georgilis from our Athens office discussed contentious issues in connection with the EU ETS:

  • What rights does a shipping company have if, for example, the time charterer does not agree to an EU ETS clause in the charter party?
  • What is the status in Greece regarding the implementation of the EU requirement to provide shipping companies with a statutory claim against the time charterer as a polluter?
  • How can statutory claims be enforced?
  • What claims does the shipping company have if a member state does not transpose the EU requirements into national law?
